The Future of Daily Fantasy Sports in New York

The events in coming days could be important to the future of the daily fantasy sports industry.

When the New York Attorney General declared daily fantasy sports “illegal gambling” last week, cease-and-desist letters went out to DraftKings and FanDuel giving them five business days to show why the AG should not initiate further proceedings.

That deadline expires this week, and in an effort to continue operating in the state while the issue makes its way through the courts, the sites are expected to file for a Temporary Restraining Order early in the week.

A judge’s decision on whether to issue the TRO is also expected this week. Without it, DFS sites will have to shut down operations in New York. Investors such as the major sports leagues and franchises may also start to divest their financial interests in the DFS companies if they are forced out of New York this week.
