Dutch Appeal Withdrawn in PokerStars.EU Tax Case on Player's Winnings
Key Takeaways
  • PokerStars launched the .EU site in February 2012, first migrating players from Sweden and Finland and then from various other European countries.
  • “PokerStars is pleased that the Belastingdienst has withdrawn its appeal against the Amsterdam Court of Appeal ruling”
  • The intent of establishing the additional licensed site in the EU was to “remove any existing uncertainty regarding taxation of players’ winnings.”
  • Recent statements caution that PokerStars “is not in a position to provide taxation advice to individuals.”

Dutch tax authorities have withdrawn an appeal to the country’s highest court that sought to reverse the tax status of winnings earned on PokerStars.EU.

According to a November 2015 Amsterdam Court of Appeal decision in a case brought by player Freerk Post, winnings by Dutch players on PokerStars.EU are not taxable, as the site is licensed in the EU member state of Malta and no additional taxes can be levied.

PokerStars acknowledged the proceeding which in effect finalizes the issue moving forward.
