- Steve Verrett, President of the Wisconsin Poker Players Alliance, and poker pro Mark Kroon launched the case after the DOJ stopped a poker game in the Players Sports Bar in Madison where Kroon is a part-owner.
- Niess first conceded the argument that skill predominates over luck, but found that to be irrelevant. Poker is “as much a part of the American fabric as baseball and apple pie,” said Niess. “But having said that, I can’t ignore the law.”
