According to trace routes from the United States, the Full Tilt Poker website, accessible through fulltiltpoker.com, is now hosted on servers located in Kahnawake Territory just outside Montreal, Canada. The poker room at the time of writing is still offline.
On Wednesday, the Alderney Gaming Control Commission (AGCC) suspended Full Tilt’s license after an investigation in the wake of the Black Friday indictments. Soon after, the lights abruptly went out in the poker room.
It is still unclear whether the change in server is the first step in moving their operations to Kahnawake and re-opening with a KGC license, or simply a quick switch away from Alderney to an existing server in order to keep the website alive.
The Alderney developments may make the KGC think twice about issuing a license. A Memorandum of Understanding (MOU) between the AGCC and the KGC may prevent any such deal.
On May 10, 2010, the two commissions signed an MOU “which will provide an efficient and reasonable channel for the exchange of information,” according to a press release from the KGC.
It would cover “past, existing and prospective licensees” to ensure “effective regulation between both jurisdictions.”
Considering that Alderney deem that Full Tilt are in breach of their licensing terms, it is unclear how the KGC could offer a license whilst remaining consistant with the terms of the memorandum.
Depending on the wording of the agreement – the specific content of which is kept confidential – the agreement could be legally binding.
