Connecticut is one of eight US states where real money online poker is legal. Unfortunately, regulated real money online poker is live in just half of those states — and Connecticut isn’t one of them.

Lawmakers in the Connecticut General Assembly passed a bill legalizing online poker, casino gaming, and sports betting in May 2021. Democratic Governor Ned Lamont signed the bill into law later that month. Online sports betting launched in September of that year, followed by online casino in October 2021.

The law authorized the state’s two tribal casinos, Foxwoods Resort Casino and Mohegan Sun, to partner with one operator to conduct igaming in the state. Foxwoods ultimately decided to form a partnership with DraftKings while Mohegan Sun picked FanDuel as its igaming partner. Online casinos and poker rooms are taxed at 18% for the first five years, increasing to 20% for the sixth year and beyond. Sports betting is taxed at 13.75%.

Why isn’t regulated real money online poker available in Connecticut? There are two reasons why regulated real money online poker isn’t available in Connecticut. First, the two tribal casinos authorized to conduct igaming are partnered with two operators (DraftKings and FanDuel) that don’t have an online poker platform. The casinos aren’t allowed to have different operators per vertical. Second, shared liquidity is also illegal under state law.

According to the Connecticut Department of Consumer Protection (CDCP), which serves as the state’s gaming regulator, state law does not allow multiple operators to be associated with a gaming license. But it also remains unclear how the CDCP defines “skin” and “operator.”

Gaming laws in Connecticut also do not allow shared liquidity, meaning that Connecticut will be a segregated market if one of the two tribal casinos launch an online poker product. It doesn’t appear that operators are allowed to share liquidity with in-state partners, either (meaning, for example, that BetMGM couldn’t share liquidity with Bwin Poker and partypoker, like it does in Ontario).

Connecticut would also not be able to join the Multi-State Internet Gaming Agreement (MSIGA), a gaming compact that supports online poker by allowing operators to combine player pools across its member states. MSIGA currently includes Delaware, Michigan, Nevada, New Jersey, and West Virginia.

How Connecticut Could Move Forward

Membership in MSIGA would help Connecticut grow its regulated space for real money online poker. But lawmakers would first need to amend the state’s gaming laws to allow shared liquidity.

If lawmakers change the law and make shared liquidity legal, there are three scenarios considered the most likely for helping bring regulated real money online poker to Connecticut:

  • DraftKings or FanDuel could acquire an online poker platform. There’s a precedent for the idea — rival Rush Street Interactive (RSI) acquired the Run It Once Poker poker platform in March 2022.
  • Either operator could partner with a third party, whose software would power an online poker room called “DraftKings Poker, Powered by [Third Party],” or something similar.
  • FanDuel’s parent company, Flutter Entertainment, could license one of its online poker platforms (PokerStars would be the most likely choice) to FanDuel, thereby creating an online poker room called “FanDuel Poker, Powered by PokerStars,” for example.
